She is the daughter of Dr John Llewellyn Payne (1837-1894) and Mary Francis (McGregor) Payne (1842-1883). She had siblings Robert Walter Payne, Albert McGregor Payne, Paddy Overton Payne, and John Wright Payne. She was married twice in her life. Ninnie married Robert Seymour Clayton (1858-1901) and together they had children John Albert Clayton, Robert Fentress Clayton, and William Clarence Clayton. Ninnie then married Ed Jenkins Leath (1874-1957) and they had children Banyan A. Leath, Edward E. Leath, and Hons Allie Leath.

Her father Dr John Llewellyn Payne was born on January 15, 1837 in Tipton County, Tennessee, United States of America and he passed away on August 15, 1894 in Hays County, Texas, United States of America. Dr. John L. Payne graduated Magna Cum Laude from the University of Tennessee at Nashville in 1862. He got his Medical Diploma at the same time as Dr. James Elliott Blaydes, who later married John's sister, Malinda E. Payne. They had gone to medical school for two years to become doctors. Shortly thereafter, John L. Payne served as a Captain in the 12th Tennessee Calvary, Company C. After marrying Mary Frances McGregor in 1861 and after his home was burned in 1863 by Yankees, John and his family moved to land in Hays County, Texas which had originally been bought by John's father Banyan. John and Mary Frances had eight children, four of whom were born in Texas. Her mother, Mary Francis McGregor was born on February 11, 1842 in Tipton County, Tennessee, United States of America and she passed away on January 2, 1883 in Hays County, Texas, United States of America. She was the daughter of Albert McGregor and Mary Eliza Overton McGregor, Mary Francis married Dr. John L. Payne on February 7, 1861 in Tipton County, Tennessee. The young family moved to Texas about 1864, settling in Hays County where John Payne's father had previously bought land.
