He married Violet Lucille (Lewis) Yates and they later divorced. He had children Horace Burlin Yates, Opal Estelle Yates Beck, Jewel (Yates) Walls, Selma (Yates) Lanier, Bobby E Yates, and Betty Jean (Yates) Satterfield. Harvey Yates died at age 42 years old on November 11, 1941 in Thomasville, and was buried at Laurel Hill Cemetery in Thomasville.
