Charges reduced for four accused of killing boxer

Four men accused in the slaying and robbery of former world-ranked boxer DuJuan Johnson were ordered Wednesday to stand trial in Recorder's Court on reduced charges, and all charges were dropped against a fifth defendant. The five - Derek Payton, Eric Payton, Calvin Preuitt, Larry Amerson and Love Rice - originally were charged with murder and armed robbery in the Sept. 19 fatal shooting of Johnson in the 11600 block of Wisconsin. Derek Payton also was charged with assault with intent to murder and using a firearm in the commission of a felony for allegedly shooting at Johnson's companion, George Jones.
But after a two-day preliminary examination, Detroit District Judge Prentis Edwards ordered Derek Payton, 17, to stand trial on a reduced charge of manslaughter and on the assault and firearms charges.
Edwards ordered Eric Payton, 18, Preuitt, 19, and Amerson, 28, to stand trial on larceny charged. All charges against Rice, 23, were dismissed. A 15-year-old is being held by juvenile authorities in connection with the case. In a related matter, Ronald Payton, 21, a brother of the defendants, was charged with obstructing justice for allegedly trying to intimidate a witness Tuesday, according to a warrant issued Wednesday.
Witnesses in court gave this account of the night of Johnson's death: Jones and Johnson drove to the Paytons' house, where Jones confronted Derek Payton about a $20 debt. After the two fought, Derek Payton and his friends went into the Payton house. Derek Payton then came out and shot Johnson, 23.
The juvenile, Eric Payton, Preuitt and Amerson then took items from the car. Defense attorneys argued that Derek Payton fired in the "hot blood" of a fight rather than in a coolly planned slaying. If convicted, Derek Payton faces a maximum sentence of life in prison. The other defendants face maximum sentences of 10 years in prison if convicted.
